OVERVIEW:
This is a contract betweenLexDukos on the first part and the User on the second part. By accessing this site or registering on it or using its services, you thereby absolutely and unconditionally agree to the Terms of Service as contained and set out more particularly herein and are thereby bound by the same.
These terms and conditions outline the rules and regulations for the use of LexDukos website located at lexdukos.com and shall set out the relationship between itself and its users. Apart from the said Terms of Service, every user shall be obliged to follow the Laws prevalent in India for the time being in force and International users will be obliged to comply with the Lex Situs in addition to the Laws of India.
LexDukos is a Premium Legal Education Platform providing an extensive range of courses from basic to advanced levels and specialisation courses.
Definitions and Terms:
Throughout the site, the terms:
- “we”, “us” and “our” (in all its grammatical variations) refer to LexDukos and its management and includes its Advisory Board, Advisory Councils, Chief Academic Advisor and Faculty. It offers this website, including all information, tools and services available from this site and other platforms incorporated into this site, to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
- User: is any person visiting or using the site, whether or not a registered student on the platform.
- Student is any person registered as a student withLexDukos and has a bonafide and valid/active login ID.
- Site: means the lexdukos site, with all its variations and add-ins and includes any page or subsite that may operate within the site. This shall however, not apply to google sites and services or services of bankers, payment gateways or any other third-party site or service, which may or may not be integrated into the LexDukos site.
- Courseware: means all information and materials posted in the Course Folders for Student attending courses.
- Fees means the amount payable to Lexdukos, exclusive of local taxes. Taxes as applicable shall be added at the time of checkout and the payment made to our bankers need to include both Fees and Taxes. ]
- Bankers/Payment Gateways: Mean the Bank in which the Proprietor’s/Firm’s Account is held and Payment gateway shall mean and include the payment platforms, Integrated payment systems/services or UPI services/apps/services which may be used by the site for the purpose of payments.
Acceptance:
By visiting our site and/or registering for any courses, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation, users who are browsers, vendors, consumers, students, and/ or faculty.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you admit to absolute and unqualified acceptance of the Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any of its services. If these Terms of Service are considered a proposal, acceptance is expressly limited to these Terms of Service.
Legal Status:
LexDukos is a Proprietorship Firm owned solely by its Founder and Promoter, Jessie Gracias.
The industry and academic partner is Lex Gracias, a full-service law firm owned by Floyd Gracias.
Rider: In the event of a change of the legal status of the firm or this brand, or its acquisition, the same shall not impact student registered to courses, which, at that time, have not yet been completed, and the courses will be completed as per the agreed structure, prior to effecting any changes to the course or its structure.
Accuracy, Completeness and Timeliness of Information
We take the highest standard of care to ensure that the information provided on our site is accurate and bonafide, however we are not responsible for information made available on this site which is inaccurate, incomplete or irrelevant. The material on this site is provided for general information and educational purposes only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information.
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or modify or amend the nature and scope of the Service or on any related website at any time without prior notice (including after you have subscribed to a course).
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including but not restricted to, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.
Data Protection and Privacy:
Any personal information you provide to LexDukos when using the website will be used by LexDukos in accordance with its Privacy Policy. Please see the data protection and privacy policy on our website for more information. The same is treated as included in this section.
For services provided by Google, like meet, drive, YouTube, etc., The Google Terms of Service/Use (or by whatever nomenclature it may so be referred to) shall be applicable to the extent of their services integrated on our platform or used separately.
The Data Protection and Privacy Policy of LexDukos forms an integral part of these Terms of Service and the same are reiterated and confirmed hereby. Please refer to our Data Protection and Privacy Policy for more details.
Modifications to the Service and Prices
Prices for our courses, and services are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to the user or to any third-party for any modification, price change, suspension or discontinuance of the course of service. Prices at the time of commencement of the Batch shall be applicable to that batch of the respective course. However, in the event of an increase in price for a course, the on-going batch, (subject to the student having paid the fees for that course) shall not be subjected to the change in price. Students of the ongoing batch of the particular course shall not be required to pay the difference in case of an increase in prices nor shall be entitled to a refund in case of a decrease in prices.
Services for Use by Registered Students: Full Service are Strictly for registered students who have paid their course fees. No unauthorised access to the site shall be permitted and LexDukos reserves the right to take the necessary action in cases of breaches or violations.
Certain aspects (the functional part) of the Services shall require you to register and provide information about yourself.
You agree to: (a) provide accurate and complete information about yourself as prompted by the relevant registration form and (b) maintain and promptly update this information (by using the appropriate forms on our Websites) and (c) that you are at least 18 years of age at the time of registration. We may terminate your account and any or all rights that you have been granted to make use of our Websites, if any information you provide is inaccurate, false, or incomplete or if you breach any part of your agreement with us.
Registration: First time users must register themselves with a verified email address with google/gmail, postal address and verified phone number and subscribe to at least one course in order to get their login credentials verified and activated. Students will be required to submit a photo ID Proof, (PAN Card/Govt. Issued ID Card (not being a driving license)/Bar Council ID/College ID Card for students/ID Card issued by your Employer for Corporate Employees only) as proof of identity of the student.
LexDukos reserves the Right to Admit or Register students and can refuse/reject an application without assigning any reasons whatsover.
After successful registration of an account student will be provided with their login credentials. First time registration is done when a user subscribes to a course. Once the payment is made, information of that transaction via email needs to be sent on education@lexdukos.com for confirmation. A confirmation email will be sent to the user verifying the payment. Only once the payment is confirmed by our backend, the course will reflect in your course folder. Existing users can add courses after login and the course will reflect in their course folders once the payment is confirmed.
Login: After successful verification, registration and payment of the first course, the student will receive a login id and password for access to the LexDukos site.
The registration processes on our Websites may involve you creating a password to enable you to access your account. You are responsible for maintaining the confidentiality of your username and password and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify us of any unauthorized use of your account and any other breach of security, and (b) ensure that you exit from your account at the end of each session. We will not be liable for any loss or damage arising from your failure to comply with these obligations.

Payment Method –
Course Payments can be made via to our bankers or Via NEFT/IMPS to our account.
Schedule of payment
The duration of our classroom courses and the validity of our online courses are fixed. The course duration and validity are clearly mentioned within the description of these courses. The duration of the courses offered by us vary from 1 month to 1 year and each course shall specify the number of hours and the schedule for the course/batch.
Payments in respect of such courses need to be made at the time of Registration and all registration to courses is Prepaid. No credit shall be provided under any circumstance.
Taxes –
LexDukos currently does not require to charge GST and therefore GST is not applied. GST shall be applied as and when applicable at such rate as applicable for the time being in force without any prior notice.
Cancellation policy –
LexDukos does not accept any cancellations. In exceptional circumstances or on account of an emergency, the student, if unable to attend the batch of the course to which he/she subscribed, shall be accommodated in the immediately subsequent batch of the same course. No offset of fees or transfer to another course is permitted. This may be done once, for the immediately succeeding batch of the same course only.
Refund policy –
There is no refund or withdrawal policy. Once payment is received refunds will not be processed. Students can however attend the next batch of the same course in case a situation demands that the batch they had paid for cannot be attended. Transfer of course batch can be offered only once and not repeatedly – if a student cannot attend the immediately subsequent course batch the fee will be forfeited. No change/swapping of course can be done once payment for a particular course has been received and logged. No student can change their batch after attending more than 5hours of lectures for that course.
Refunds will be provided to the students only if the course has been permanently discontinued or in the case of total closure of business or in the event that the contract between the student and us is incapable of performance.
Repeating classroom courses
You are entitled to attend classes only with the batch that you have enrolled for at the time of signing up for the course. If for some reason, you could not complete the course with the batch or you would like to repeat either a part of the course or the entire course, you will have to pay a readmission fee, as per the prevalent course and batch terms.
Code of conduct –
LexDukos strictly enforce its code of conduct for students and expects students to adhere to our code of conduct as as strictly as possible and as contained hereinbelow: –
- The students must keep their camera on during the lectures at all times. If there is a connectivity issue, the student may seek the permission of the lecturer to keep their camera off for a few minutes, but register their participation on the chat window. The student cannot keep their camera off throughout the lecture without prior permission from the lecturer.
- The students must keep their mic off during class to avoid disturbances to the lecture. If he/she wishes to speak, they can use the raise hand option or ask for the faculty’s permission in the chat box and can unmute himself/herself for that duration. Students may ask doubts, if the faculty permits, by using the raise hand option and speaking only when the faculty permits the student to do so. We request students to refrain from interrupting the lecture and respect each faculty’s preferences.
- Faculty would spend the last few minutes of every lecture solving student’s doubts.
- The student must enter the meeting within the first ten minutes of class. Thereafter, no attendance for the lecture shall be granted to the student and it is solely up to the discretion of the concerned faculty for that lecture to allow you to enter the meeting or not.
- Students are expected to maintain decorum during the meeting and not disturb or disrupt the proceedings. In the event that a student disrupts a meeting, the student will first be warned by the faculty, whereafter if the student persists, the student shall be removed from the lecture and not allowed to re-join that lecture. In the event that a student is removed thrice during a course/batch, the student will be debarred from LexDukos, whereupon, their login account shall be terminated/deactivated and they will be forthwith removed from the course and all other courses (if applicable) at LexDukos. No refunds shall be provided in such cases. Decisions of the faculty, the Advisory and the management of the LexDukos shall be final in the case of disbarment of the student.
- Students are required to respond to questions posed to them by the faculty during a lecture and partake in any discussion, debate or teamwork.
- Students must not directly contact the faculty in case of any doubts. All the doubts are to be resolved during the online meeting sessions. Students shall, under no circumstances whatsoever, take photographs, video recordings, screenshots, screen-recordings of lectures while they are in progress or share, publish or otherwise circulate such recordings from our website.
- Notes and Presentations are for your academic use only and circulation or publication of the same is strictly prohibited.
- Students are discouraged and prohibited from contacting or communicating with the faculty outside of the lectures or on a personal basis. All communication should occur during the lecture or through education@lexdukos.com . In case of any other doubts regarding the course or the website or in case of technical difficulty, contact education@lexdukos.com.
- Student discretion, at all times, is counted upon and we solicit your cooperation in maintaining the decorum on our platform and the standards of our courses and site.
Third-Party Materials
All information provided on the site is property of LexDukos. Courseware, notes, presentations or other information is curated and created by the LexDukos or Lex Gracias teams for LexDukos and are property of LexDukos.
Judgements which are reportable and published in the public domain and bare acts of laws, policies, notifications etc., are public information and LexDukos claims no rights of any sort over them.
Faculty may share reference material or links for academic purposes on the Google Meet Chat or otherwise. This shall be done in their personal capacity to assist students. All Intellectual property rights thereof are that of their respective owners. We claim no right in respect thereof and no liability for the same either. LexDukos shall not subscribe to or confirm the views expressed in such information or articles.
You agree that we have no responsibility or liability for the deletion or failure to store any messages, other communications or other content maintained or transmitted by our Services.
We reserve the right to deactivate accounts that are inactive for an extended period of time.
Course Folders and Information: Information regarding the courses selected by the students, its syllabus, notes and courseware can be found in the course folders. The folders shall also contain links to the lecture sessions on Google Meet and the links to the Recordings of Earlier Lectures.
Live Lectures: Lectures are conducted by the faculty via google meet. Google Meet login links will be added in the course folders 10 minutes prior to each lecture or there may be a common link for all lectures. Rights over content, opinion and views expressed during the live lectures are not the liability of LexDukos and belong to the faculty and the students respectively.
Faculty and Students may express their own opinions in the course of discussions during the Lectures. The opinions, views and contentions expressed are the respective opinions of such students and LexDukos does not confirm or subscribe to the same. LexDukos bears no liability in respect of such comments/statements/ views/opinions or contentions.
Recorded Lectures: All the recorded files/recordings of the lectures are the sole property of LexDukos and no faculty or student can claim any rights over them. All faculty and students hereby grant consent to LexDukos to store the records of google meet classes/sessions and host them on Google Drive for view to our registered students of the same batch and course only. LexDukos reserves the right to use extracts, excerpts and still images thereof, for promotional and marketing or representational purposes.
Attendance – Attendance is compulsory. Students who are registering courses with us are required to attend online lectures on a regular basis. Candidates must have at least 75% attendance during the tenure of the course in order to qualify for the Certificate.
Participation in Lectures – Students are required to regularly participate in lectures when the faculty demands for it. If the faculty asks for a student and the student does not reply then such student will be marked as absent for that lecture.
Completion of Assignments – Students will be given assignments to submit throughout the duration of the course, diligently and in time. It is compulsory for the students to submit all assignments. Non-submission of even one assignment would disqualify the student from getting the certificate on the completion of the course.
Examination – A final examination will be conducted which is mandatory for the students to appear for. Failure to appear for the examination would mark the student as absent and such student would not qualify to obtain a certificate at the completion of the course. Certification will not be issued without final examination. No re-examination can be scheduled. Examinations will be conducted online on our website.
Certification Criteria: Certificates are provided by LexDukos. Students are eligible to receive a certificate after the completion of the course only if they have successfully submitted all the assignments throughout the duration of the course and attempted the final examination. Students shall receive a soft copy of their certification on their respective email addresses and a hardcopy of the certificate shall be sent to the address of correspondence provided during the time of registration.
Continuous Internal Assessment: Faculty shall monitor continuous internal assessment in the duration of the course.
Moot Court/Discussion – There shall be a Moot Court/Discussion/Presentation as part of the Continuous Internal Assessment for each course.
Amendment to the course structure –
Presentation and courseware will be reflected and updated in the course folder as the course progresses. Syllabus and notes may be amended and modified at any time before or during the course without any prior notice.
Ownership / proprietary rights / license
No intellectual property rights of any kind are assigned or transferred to users under this Agreement. Students are permitted to access and use the content and any other materials provided hereunder only as expressly set forth in these Terms of Service. Users are not permitted and shall have no right to use the content for any purpose other than as set forth herein.
Unless otherwise indicated, the LexDukos is the owner or the licensee of all intellectual property rights in our Websites and/or Services (including any content made available through our Websites and/or Services and the underlying source code with regards to the software that we use).
LexDukos grants you a personal, non-transferable and non-exclusive licence to use our Websites and specific Services for their intended purpose, subject to your compliance with these General Terms.
Ownership of content submitted by third party
By providing any Content to our website: you agree to grant to us a worldwide, royalty-free, perpetual, non-exclusive right and license (including any moral rights or other necessary rights) to use, display, reproduce, modify, adapt, publish, distribute, perform, promote, archive, translate, and to create derivative works and compilations, in whole or in part. Such licenses will apply with respect to any form, media, technology known or later developed.
You warrant and represent that you have all legal, moral, and other rights that maybe necessary to grant us with the license set forth in this Section. You acknowledge and agree that we shall have the right (but not obligation), in our sole discretion, to refuse to publish or to remove or block access to any content you provide at any time and for any reason, with or without notice.
Prohibited Uses/ conditions of use
In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses. The website is to be used only for educational purposes.
Objectionable Material –
We at LexDukos assure that the material(notes) provided by us is accurate and not objectionable. LexDukos has no rights over live lectures of the faculty. However, rights over the recordings of the lectures are property of LexDukos. LexDukos is not liable for the views and opinions expressed by the faculty and students on the website. Therefore any opinion shared by the faculty or the student which may be offensive to an individual is not the liability of LexDukos.
Force Majeure –
LexDukos shall not be liable to you for any breach of its obligations or termination under these terms and conditions arising from causes beyond its reasonable control, including, but not limited to, fires, floods, earthquakes, volcanoes and other Acts of God,, strikes, Pandemic resultant lockdowns or Govt. Regulations, failure to provide a course caused by a death in the faculty’s family, illness of the faculty, Government edict or regulation. Disruption of Lectures or if a lecture is cancelled on account of an emergency on the part of the faculty or in case of technical issues shall be rescheduled or compensated. However, no compensation of any sort can be claimed by a student in respect thereof.
Disclaimer of Warranties; Limitation of Liability
We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.
We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. While we strive to educate our students to the best possible extent and impart High Quality Education to Set them Apart From their Competitors and Peers, we do not guarantee the performance of any student and individual performance may vary.
You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall LexDukos, its proprietor, directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
LexDukos is only liable monetarily, to the extent of the fees collected by itself for any course which the user/student registers for. LexDukos is in no manner liable for any incidental or other losses or compensation or damages beyond the amount of the Fee Collected in respect of the course in question.
Placement –
LexDukos does not provide and guarantee any placement or employment on completion of courses on our website to its students.
Affiliation:
LexDukos is an Independent Academic Portal for Legal Education Online and is in no manner whatsoever affiliated or accredited to any University, College or other body.
Courses done on LexDukos are to equip a student with additional skills; however it does not entitle a student to practice law, solely on the basis of our certificate, without a recognised law degree.
Governing Law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India and Maharashtra.
Jurisdiction –
The parties to this agreement submit to the exclusive jurisdiction of the competent courts in Mumbai only.
Indemnification
You hereby agree to indemnify, defend and hold harmless of consequence, Lex Dukos and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
Changes to Terms of Service
You can review the most current version of the Terms of Service at any time at this page on our website.
We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website, without any prior intimation or notice. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
Severability
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
Term and termination
This Agreement will become effective upon the User using the website. There is an implied acceptance to this Contract by way of use of this site.
In the event of Students using Services, your acceptance of the terms of this Agreement by Your clicking on the “I ACCEPT” button and, subject to the terms and conditions of this Agreement, will remain in effect while the Participant maintains a current, fully paid online registration to the program, or until terminated by LexDukos.
LexDukos may discontinue or change the program, or its availability to You, at any time without notice, but not during the subsistence of an ongoing batch. The program registration, once purchased, is not returnable.
Login Credentials, if not used for over a period of one year from the last date of login, shall be deactivated and removed totally from our systems.
